Terms of Service

By accessing or using Instant Market Test (“IMT”, “the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service. These Terms form a legally binding agreement between you and AIWean Limited, a company incorporated in Hong Kong.

These Terms apply to all users of the Service, including visitors, registered users, and paying subscribers.

IMT is an AI-powered synthetic market research platform. It uses large language models to generate virtual audience personas and simulate their reactions to your product or business concept, returning quantified insights and strategic recommendations.

Important disclaimer: All personas, responses, scores, and insights are synthetic outputs generated by AI models. They do not represent the views of real individuals and should not be treated as primary market research. IMT is a decision-support tool intended to complement, not replace, professional market validation.

You must be at least 18 years of age to use the Service. By registering, you represent that you meet this requirement and have the legal capacity to enter into a binding contract. If you are accessing the Service on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms.

You are responsible for:

• Providing accurate and current information during registration
• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately at info@aiwean.com of any suspected unauthorised access

You may not share your account credentials with third parties or create accounts on behalf of others without express authorisation. We reserve the right to suspend accounts that show signs of unauthorised sharing.

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable regulations
• Submit content that is defamatory, fraudulent, obscene, or that infringes third-party intellectual property rights
• Attempt to reverse-engineer, decompile, or extract the underlying AI models or algorithms
• Use the Service to generate disinformation, propaganda, or content intended to deceive
• Resell, sublicense, or provide third parties with access to your account
• Circumvent usage limits, billing controls, or authentication mechanisms
• Use automated scripts or bots to interact with the Service outside of any officially provided API
• Interfere with the security or integrity of the Service or its infrastructure

We reserve the right to suspend or terminate access for any user found to be in breach of these acceptable use requirements.

The Service uses Anthropic’s Claude language model to generate synthetic personas and analytical outputs. You acknowledge that:

• AI outputs can be imperfect, inconsistent, or contain inaccuracies and should be interpreted accordingly
• Simulation results are probabilistic estimates and may not accurately predict real-world market outcomes
• You are solely responsible for any business decisions made on the basis of IMT outputs
• We do not warrant that any particular result, recommendation, or score will be fit for your specific purpose

We treat your submitted project content and simulation outputs as confidential. We do not share your data with other users or third parties except as described in our Privacy Policy. We do not use your content to train AI models.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESULTS WILL BE ACCURATE OR RELIABLE. AIWEAN LIMITED MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY OF THE SERVICE FOR YOUR PARTICULAR BUSINESS NEEDS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AIWEAN LIMITED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES — ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO AIWEAN LIMITED IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR USD 100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages. In such jurisdictions, our liability is limited to the greatest extent permitted by applicable law.

You agree to indemnify, defend, and hold harmless AIWean Limited and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; or (c) your infringement of any third-party intellectual property or other rights.

You may delete your account at any time by contacting us at info@aiwean.com. Upon deletion, your right to use the Service ceases immediately and your data will be removed in accordance with our Privacy Policy.

We reserve the right to suspend or permanently terminate your account, with or without notice, if you violate these Terms, engage in fraudulent activity, abuse the Service, or for any other legitimate reason. If we terminate your account without cause, we will refund any prepaid and unused subscription credits on a pro-rata basis.

We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before they take effect. The “Last updated” date at the top of this page reflects the date of the most recent revision. Continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People’s Republic of China, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of the Hong Kong SAR.

For users resident in the European Economic Area or United Kingdom: nothing in these Terms limits any rights you may have under applicable mandatory consumer protection laws in your country of residence.

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AIWean Limited with respect to the Service and supersede all prior or contemporaneous understandings, agreements, or representations.
